Prayers Needed !!!

My nephew was attacked near Ohio State University at a college bar. He was knocked down and during the fall he sustained a severe skull fracture. He is at Grant Hospital (where he is a student nurse). Luckily a trauma surgeon and trauma nurse were close by and came to his aid. He is in ICU and things dont look good. He has severe brain swelling and they fear the worst. Our family needs prayers. His brother was with him at the time and said that it was some *******, who neither knew, just picked my nephew as his target. The police are reviewing video at the club to get an ID on the guy who attacked him. This was a needless act and frustrate the hell out of me. Please pray for my family, Thanks

I agree with you Jim. Too often. A frined of mine was stabbed six times trying to deliver a pizza. It wasn't a robbery. It was two teenagers who had to kill a cracker to be in a gang.

Update. He took a turn for the worse, early this afternoon. He developed a fever and had problems breathing. They finally were able to releave pressure in his brain, but they are saying to be prepared for damage. The pressure was too high for too long they say. They have now put him into an induced coma to see if that will help him. Thanks again for all your thaughts. No word on the guy who assaulted him.

Oh, man, I HATE this senseless ****, my prayers go out to your family. This kind of crap needs to be stopped. Hopefully they will ID the guy and actually make him answer for his actions. Not that it will help the injured, but still, it's a start.

They were taking him into surgery today to remove to pieces of his skull. His brain started to swell again and more relief is needed. Doctors said to prepare for the worst, but hope for the best. Good kid studying to be a nurse, never hurt anyone. Just at the wrong place at the wrong time. Thanks to all for thier prayers and thaughts.

You have me and my family's prayers as well. Since we are going through something similar as well.

One thing that we found, is that the doctors never want to give to much hope. Just in case if they are wrong. Take everything they say with a grain of salt.

My father in law was struck by an out of control car almost 4 months ago. The doctors prognoses at the time was very bleak. But, he's still here. My hope for you is that the same exsist. That the doctors are just being conservative.

Oh man. I'm really sorry to hear this. You hear about these things from time to time and you kind of brush it off, but it really is significant for those whose families must deal with this sort of senselessness. My prayers go out to you and your nephew!

The surgery to remove brain pressure went fine and pressure was releaved. But now his face and body is swelling. They think the fluid on his lungs is causing this. He is still in an induced coma and they plan on stopping that tomorrow to see how he responds. Who knows seems at times they just guess. Thanks agin for the prayers and thaughts. I will keep the thread updated.

Any progress on identifying the scumbags that did it?

Glad to hear surgery went well...remember, doctors know more than we do, but are really still just incredibly educated guessers, the human body is an amazing machine that nobody completely 100% understands.

The Columbus police reviewed the video tapes and have the guy on film. Also a patron of the bar came foward and said a friend of his knows the guy and said he would identify him in a line up. They are looking for him and its just a matter of time before they have him. The only good news of the day.

Cant sleep. Recieved a call from my sister around 3:00am. My nephew Nick had a massive stroke and has passed away. My sister and husband are making arangements then heading home. Thanks to all who kept us in your prayers and thaughts. Please think of my sister, her husband and their other son. It will be hardest on them. Thanks again. Mike

COLUMBUS, Ohio -- A weekend attack outside of an Arena District nightclub turned deadly with a single punch.

It was a single punch with grave consequences. Nick Foss, 29, died yesterday.

ONLY ON 4: NBC 4's Ana Jackson spoke with the Foss family as police searched for a suspect.

A confrontation over a bottle of beer led to the fatal strike that killed Charles and Terri Foss' son.

"We had 29 wonderful years with him, but, of course, we were hoping we would have many, many, many more," Charles said.

Saturday became a walking nightmare for the Fosses. They said someone knocked Nick unconscious. Medics rushed him to Grant Medical Center with brain damage.

"I knew he knew I was there with him," Terri said. "That was probably the hardest time for me -- when he looked at me wondering what was going on. His eyes got so big. It was horrible."

Nick fought for his life in the same place where he fought to save so many other lives. He was training to be a nurse at Grant.

Doctors declared Nick brain dead Tuesday morning.

"We're a very close family," Terri said. "It was devastating."

Nick continued saving others even in his death: His parents are donating his organs.

The guy came forward. Spent the last week getting an attorney and his story straight. His lawyer is claiming he was "Protecting His Property". So he hit my nephew from behind, killing him to protect his beer, that my nephew didnt take. What a tool. Looks like a jury trial. But at least they have him. The police are not telling the family his name, but through our own sources, we have it. Hope this ****er, burns in hell !!!!!!

That's good news man. I'm glad that you and your family will be able to pursue justice in this case. Hopefully the jury sees through his thin veil and the judge is able to throw the book at him.

... yeah... defense of personal property except home is not exactly a good idea in ohio...

I know a new self defense bill is running around but the Ohio revised code on codes.ohio.gov/orc/2305 isn't updated with it yet so I guess it still has to go though the Senate... in any case.

Generally speaking, 'if you did the right and legal thing' in killing someone you absolutely do not want a jury trial. So if it does go to jury his lawyer is almost certainly going for either a chewbacca or confuse-a-cat defense...

chewbacca defense: Basically going horribly off topic in an attempt to confuse the jury.

Confuse-a-cat: good example is SCO vs. IBM ... lots of show, but when it really gets down to it...it is allowed to continue out of morbid curiosity.




HOWEVER ....

_OFTEN_ a defense attorney will go for a jury trial in hopes that a plea deal will be offered... and then either take the deal... or (LIKELY) completely admit guilt right before jury selection to gain reduced sentencing which often comes from not going through the hassle of a jury trial.

Defending an obvious case only serves to piss off the judge for sentencing.

Yep, wishing the worst for this moron from here. I hope they give him the worst sentence they can. And the lawyer if he is jerking around should get a dose of it as well.

I'm sure there will be plenty of witnesses in your nephews defense stating that this is completely absurd.

The police and presecuting attorneys wanted to get this right. So even though the guy who hit Nick (my nephew) came foward, they had not charged him. They went over the evidence and witness accounts and finally arrested him last night. They want to make sure the charges stick. William B Saxbe (former Ohio State Senator and Attorney General and Ambassador to India) is from my families home town. Very small home town and every one knows each other. As soon as he heard about Nick he got involved also. Our thanks to Mr. Saxbe for helping. Here is local news story.

COLUMBUS, Ohio — A man accused of throwing a punch that killed another man outside a bar earlier this month was arrested on Monday.
Brent Goode, 22, was charged with involuntary manslaughter in the death of Nickolas Foss, who was struck in front of the GasWerks bar, located 487 Park St., in the early morning of April 6, 10TV's Lindsey Seavert reported.
Foss, 29, died three days later of a brain injury.
Goode turned himself in Monday night, police said. He will be arraigned Tuesday, 10TV News reported.
Earlier Monday evening, Foss' parents attended a memorial service at Grant Medical Center, where Foss worked and where he ultimately died.
"It's so sad for us because it's a needless loss of two lives," Foss' father, Chuck Foss of Mechanicsburg, told 10TV. "No matter what happens, it will never bring Nick back. Never."
